The owner of the www.rushify.ca website (hereinafter referred to as the "Site"), represented by the Site Administration (hereinafter referred to as the "Receiving Party"), commits to protecting the confidential information and personal data of Clients and Executors (hereinafter referred to as the "Disclosing Party").
DEFINITIONS Disclosing Party — Clients and Executors who possess confidential information and personal data, which are transferred to the Site Administration upon registration and use of the Service. Receiving Party — The Administration receiving confidential information and personal data in the process of providing services to Clients and Executors. Confidential Information — Information that is not public, disclosed by the Disclosing Party to the Receiving Party. Such information can be labeled as "confidential," but may also be unlabeled; however, its content should be treated as confidential. Confidential information includes, among others: information on the level of technical development of the Disclosing Party, as well as successful technical solutions and prospects for improvement in the relevant field; details of the marketing or advertising strategies of the Disclosing Party in promoting their goods, works, and services; information on the commercial policy or business plans, including information on existing or prospective projects and contractors; information received from third parties, towards which the Disclosing Party has confidentiality obligations. Information is not considered confidential if it: is already public, and its disclosure does not infringe upon the rights and lawful interests of the Disclosing Party; was known to the Receiving Party before the Disclosing Party's account registration on the Site; is provided by the Disclosing Party with a written note stating it is not confidential; pertains to information about the fact of using the Service by the Disclosing Party. Personal Data — Information or a set of information about the Disclosing Party, which can be used to identify such a Party. The categories of Personal Data of the Parties within the Service include: surname, first name, patronymic (if applicable); email address; date of birth; residential address; phone number; and other data that can identify their owner.
GENERAL PROVISIONS
1.1 The purposes for the Receiving Party to obtain and process confidential information and personal data are: providing the Disclosing Party with access to the Service's capabilities, information, and materials available on the Site; facilitating communication between the Parties; ensuring the successful execution of the contract for work/performance of services, concluded by Clients and Executors using the Service.
NOTIFICATIONS
2.1 Visitors to the Site, who do not register an account, are informed and agree that the Receiving Party is entitled to collect certain information about such visitors, including URL and IP addresses, etc., viewed during their visit. This information is used exclusively for internal purposes to improve the Service's operation.
2.2 The Receiving Party processes only the confidential information and personal data necessary for providing quality services and does not use such information for other purposes without the consent of the Disclosing Party.
2.3 The Receiving Party retains confidential information and personal data for as long as necessary for the stated purposes in accordance with applicable law.
2.4 The Disclosing Party is provided unrestricted access to its confidential information and personal data.
2.5 The Receiving Party does not transfer the confidential information and personal data of the Disclosing Party to third parties without the consent of the information owners, except in cases expressly provided by law.
OBLIGATIONS
3.1 The Disclosing Party undertakes to provide only truthful and complete information.
3.2 The Receiving Party undertakes to: use confidential information and personal data exclusively for the purposes of operating the Service and executing the contract for work/performance of services using the "Safe Deal" Service; not disclose confidential information to third parties except in legally specified cases; not use confidential information and personal data for purposes that contradict the objectives specified in section 1.1 of the Privacy Policy; limit the number of employees and other persons having access to confidential information and personal data, ensuring they commit in writing to not disclose and not use the Disclosing Party's confidential information and personal data for their own or others' interests; promptly notify the Disclosing Party of any detected unauthorized use or disclosure of confidential information and personal data, taking all necessary measures to prevent further unauthorized use or disclosure of such information; destroy or return the received confidential information and personal data upon the Disclosing Party's request.
FINAL PROVISIONS
4.1 The Site's User database is formed by the Administration exclusively for internal use. The Administration takes necessary software and technical measures for its protection but is not responsible if the User database becomes accessible to third parties as a result of unlawful actions.
4.2 Upon deletion of the Disclosing Party's account, that party's personal data is immediately deleted, provided that the Disclosing Party was not previously involved in fraud on the Site and has submitted a corresponding request to the Receiving Party via email: info@rushify.ca.
